As it's now less that 6 months until the one-year grace period for EU cookie directive comes to an end, Wilson Cooke offers advice on what this means for your business and what you should be doing.
What does this mean?
The new regulation around cookies comes into force 26th May 2012 and the Information Commissioner’s Office (ICO) stipulates that all UK websites will require the full consent of the end user in order to continue using cookies. Can't I just ignore this?
It is expected the ICO will take proceedings against any company that fails to meet the new requirements so ignoring this could result in large fines. As yet, there is nothing to say this will go away so it is very important to start planning for this over the next few months so as not to risk falling foul of these new requirements.
Ok, what should I do?
First step is to complete an audit on your site to see what cookies are being stored and what they are used for. The result of this audit is vital to identify a solution that minimises the impact the directive has. If you have already conducted an audit and have these results then you are already a step ahead of a vast majority of websites in the UK. The government has promised guidelines to help businesses to find the right solution; as yet these have not materialised but are likely to have a big impact on the best approach to take.

The ICO has also just released its updated guidance for UK website owners which we are also reviewing. Once you have conducted a cookie audit on your site we recommend waiting just a little bit longer for us to conclude our research and then advise the best approach to take on your website.
We will send another reminder out February-March but the key is to be fully aware of this future directive and know this will impact your website in some way. We would advise that all websites have implemented a suitable solution before the end of April so as not to risk leaving this too late and possible falling foul of this new regulation.
